Where are commercial disputes filed in Shimla?
Commercial disputes of specified value are filed before the designated Commercial Court in Shimla under the Commercial Courts Act, 2015, with appeals to the Commercial Appellate Division of the HP High Court. We appear at both levels.
Is mediation compulsory before filing a commercial suit?
Yes, in most cases. Section 12A of the Commercial Courts Act requires pre-institution mediation unless urgent interim relief is sought. A suit filed without complying can be rejected, so this step must be handled correctly.
